ICE must be stopped!
You might remember the story of Rachel and Gui from our newsletter a few weeks ago. They are friends of a member of INC's steering committee.
Gui is still being held. You can help by contacting CA and WA reps and senators NOW and demand they do something about Gui and the many people being kidnapped and held unlawfully by ICE.
Here is the latest full story (with talking points for you):
Guilherme (Gui) Silva is a resident of California who was unlawfully detained by ICE, denied due process, and is now being held in state prison on unsubstantiated criminal charges. His pregnant wife, Rachel, is due to give birth in early October and is facing this crisis alone. They are married and have been going through all of the necessary processes to obtain a green card for Gui.
On July 11, Gui was intercepted by masked ICE agents in 6–7 unmarked vehicles in Friday Harbor, WA. No warrant was presented. He was forcibly removed from his vehicle while on his way to pick up his daughter. His phone was confiscated, and he was transported off the island by private boat. He was mocked and mistreated by agents and later held in a temporary facility for 38 hours in inhumane conditions — well beyond the legal limit.
After being transferred to the Tacoma ICE facility, a judge ruled on July 29 that Gui should be released on bond. His wife paid the bond in full that same day. However, Gui was not released. Instead, he was secretly transferred to a Washington state prison by ICE and local law enforcement, without a warrant or proper turnover documentation — a process that reportedly occurred in a Costco parking lot.
Following this irregular transfer, state authorities filed a felony charge related to child pornography — a devastating and baseless accusation. According to court documents and the legal team, the alleged “evidence” appears to be innocent family photos of Gui’s 4-year-old daughter in a bathtub — something many parents have. No evidence was presented at his first hearing, and the prosecution was granted three additional weeks to produce any.
Bail was set at $250,000.
This charge did not exist in Gui’s ICE file before July 29th. In fact, sources familiar with ICE procedures have stated that he should have been informed of any criminal investigation at the time of his detention or transfer, which did not happen.
Rachel is 7 months pregnant, has had to take extended time off work, and is traveling between California and Washington to manage this crisis while trying to prepare for childbirth. She is emotionally, physically, and financially exhausted. The GoFundMe created to support legal fees is being rapidly depleted by emergency costs, housing, and travel.
This case is emblematic of larger systemic issues:
Arrests without warrants or judicial oversight
The use of secret transfers and fabricated charges to circumvent immigration court rulings
Lack of accountability between ICE and state law enforcement agencies
The criminalization of immigrants using deeply invasive and questionable tactics
Urge the congresspeople to:
Investigate this case through official channels with ICE and the Washington Department of Corrections
Demand a full review of Gui Silva’s detention, transfer, and charges
Advocate for the immediate release of Gui Silva until a fair and lawful proceeding can take place
Ensure Rachel and Gui’s rights as U.S. residents and legal petitioners are protected.
